Topic: Lady Bird Deeds vs. Transfer on Death Deed
Like many things in the law, each has their good points, their bad points and, in some cases, their really ugly points. This presentation looks at the good, the bad and the ugly relating to TODD’s and LBD’s (but not trusts or survivorship agreements). Obviously, the “good”, “bad” and “ugly” characterizations are really a matter of perspective. What may be “good” to one party may be “bad” or even “ugly” to some other party to the transaction. I have attempted to make these characterizations from the perspective of the transferor and the designated beneficiaries. Finally, like many things in the law, the answer as to which one is the best to use in any given transaction is this: “It Depends!”
