TOPIC: THE ANNOTATED PHASE I ENVIRONMENTAL SITE ASSESSMENT
Prospective purchasers of commercial real estate must conduct all appropriate inquiries into the past and present uses of a property in order to qualify for protection from certain liability for the environmental condition of the property that would otherwise be imposed by CERCLA (Superfund). This investigation identifies recognized environmental conditions and states them (or their absence) in a Phase 1 Environmental Site Assessment report. In 2022, the EPA approved a new standard practice for conducting this due diligence and writing the report which, among other things, has changed the definition of recognized environmental condition. This presentation reviews this new ASTM Standard Practice 1527 and its larger environmental context so that practitioners may become aware of these critical changes.
