TOPIC: Securing an Award Attorney’s Fees at trial and Keeping that Award on Appeal 

SPEAKER: Todd Smith

This program will cover—

  1. the procedural differences between attorney-fee recovery in federal and state courts;
  2. the latest developments in proving up attorney fees in state court;
  3. preserving error on attorney-fee issues; and
  4. challenging or holding onto attorney-fee awards on appeal. 

D. Todd Smith has a statewide practice representing clients as lead appellate counsel and working with trial teams in all phases of civil litigation. Over his 25-year legal career, Todd has handled matters in nearly all of Texas’s 14 intermediate appellate courts and has briefed and argued multiple cases before the Texas Supreme Court and the United States Court of Appeals for the Fifth Circuit. In trial courts, Todd takes the lead on strategic analysis and briefing, jury charges, and potentially dispositive motions, all with a focus on preserving error and positioning cases for appellate review. He also testifies as an attorney-fee expert in select cases.
