NEW TOOLS FOR CLIENTS WITH DISABILITIES:

SUPPORTED DECISION-MAKING AGREEMENTS AND ABLE ACCOUNTS

 

Join the Estate Planning and Probate Section on Friday, December 9, 2016 for a CLE presentation presented by our own Tresi Weeks on “New Tools For Clients with Disabilities: Supported Decision-Making Agreements and Able Accounts.”  Ms. Weeks will speak on two new statutory tools attorneys and professionals need to be aware of when representing individuals with disabilities and their families. The Supported Decision-Making Agreement is a new “less-restrictive alternative” to guardianship that must be considered prior to filing for guardianship.  Ms. Weeks will also discuss the new ABLE Accounts, which allow an individual to save up to $100,000 without affecting eligibility for SSI and Medicaid.  She will explore the advantages and disadvantages of ABLE Accounts, when they will help your clients and when they should not be a replacement for Special Needs Trusts.
