Join the Estate Planning and Probate Section on Friday, June 10, 2016 for a CLE presentation on “Disclaimers.” Attorney Catherine Bright of Key Harrington Barnes, PC, will summarize the recent changes to the Texas disclaimer statues, with a focus on the new statutorily authorized power of a trustee to disclaim property that would not pass—if not for the disclaimer by the trustee—into the trust. Ms. Bright will discuss the ethical implications of disclaimers, especially by trustees, and provide examples of disclaimer strategies. Ms. Bright has used disclaimers in her practice to help clients restructure existing estate dispositions in order to accomplish strategic planning goals, including the minimization of federal transfer taxes, the avoidance of certain creditor claims or risks, increasing flexibility in the design and implementation of estate plans and altering beneficiaries' access to assets.
