Estate Planning/Probate Section Meeting
Join the Estate Planning and Probate Section on Friday, January 8, 2016 for a CLE presentation on “Hello From the Other Side: Salvaging Special Needs Situations” by Tresi Weeks, attorney with the Weeks Law Firm. Imagine that while administering your client’s will or trust you realize that a disabled beneficiary will receive distributions, but the will/trust did not include a special needs trust. The disabled beneficiary may lack capacity, or may lose their Medicaid coverage as a result of the inheritance. Ms. Weeks will discuss some strategies to salvage the situation, including decanting, court-created trusts, court modification of trusts, and savvy distributions. She will also show us what language you may be using in every document that could be fatal for a special needs beneficiary, and what language to include to avoid these situations.
