Lori Leu and Erin Peirce of Lori A. Leu & Associates will present The Effects of Estate Planning on Public Benefits.

The presentation will be focused on estate planning as it relates to elder law.  We will educate estate planning and probate attorneys on how to avoid the pitfalls of estate planning documents when planning for elderly clients and dealing with long term care.  Specifically, we will review the statutory form durable power of attorney and talk about the areas where we, as elder law attorneys, need to redraft/re-execute the DPOA in order to properly plan for our clients with dementia and Alzheimers and to be able to apply for public benefits.  This will include a discussion not only on the drafting of the DPOA and additional provisions to include, but also the importance of a  properly executed document (initialing all the blanks, and encouraging an immediately effective POA).   We will extend our presentation to include drafting of Wills for clients who are on public benefits or who have cognitive impairments, including when and how to include Supplemental Needs Trusts in Wills.
